Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of avenbites.kartexa.com (the "Site"), operated by AvenBites, a Kartexa venture. By accessing the Site or joining our waitlist, you agree to be bound by these Terms.

1. Acceptance of terms

By submitting the waitlist form or otherwise using the Site, you confirm that you have read, understood and agree to these Terms and our Privacy Policy. If you do not agree, please discontinue use of the Site.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract under the Indian Contract Act, 1872 to join our waitlist or place a future order.

3. The waitlist

AvenBites is currently in a pre-launch phase. Joining the waitlist:

• Does not constitute a purchase, order, or binding commitment on either side;
• Does not involve any payment being collected at this stage;
• Reserves your interest so we can notify you when an outlet becomes available near you; and
• May be withdrawn by you at any time by contacting us.

Launch timelines, outlet locations and early-access offers are indicative and may change without prior notice as we scale.

4. Fulfillment modes: pickup & delivery

AvenBites offers two fulfillment modes once live, selected by you at checkout:

• Self-Pickup: orders are collected by the customer (or their nominee) from the designated outlet within the pickup window shown in-app.
• Delivery: orders are dispatched by an AvenBites rider or delivery partner to the address provided at checkout, within the estimated delivery window shown in-app. Delivery availability and any applicable delivery fee depend on your distance from the nearest outlet and will be shown before you confirm your order.

You are responsible for providing an accurate pickup/delivery location, including via the in-app map picker, and for being reasonably reachable at the contact number provided for order updates.

5. Menu & "organic" claims

AvenBites sources produce, grains and select ingredients from AvenAgro's directly-operated, chemical-free farms wherever available. While we take these sourcing standards seriously, some ingredients (e.g. packaged condiments, imported spices) may not be independently certified organic; where relevant, this will be indicated on the menu. Nothing on this Site should be construed as a medical claim.

6. Acceptable use

You agree not to: (a) submit false, misleading, or another person's information without consent; (b) attempt to disrupt, reverse-engineer or gain unauthorised access to the Site or its systems; (c) use automated tools (bots/scrapers) to submit waitlist entries; or (d) use the Site for any unlawful purpose.

7. Intellectual property

All content on this Site — including text, graphics, logos and the AvenBites name and branding — is the property of AvenBites/Kartexa and may not be copied, reproduced or used without prior written permission.

8. Limitation of liability

The Site and waitlist are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, AvenBites shall not be liable for any indirect, incidental or consequential damages arising from your use of the Site, delays in launch, or reliance on information provided prior to our commercial launch.

9. Governing law

These Terms are governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts at Ghaziabad / Uttar Pradesh, India.

10. Changes to these terms

We may revise these Terms as our services develop, particularly once commercial ordering goes live. Continued use of the Site after changes constitutes acceptance of the revised Terms.
